A Binding Agreement. Our skilled Pittsburgh attorneys know how to prepare your premarital (or prenutial) agreement to be binding and enforceable. We will sit down with you, learn your goals, and come up with language in the agreement that effectuates your intent. Does "Fairness" Matter? The law does not require that the agreement be "fair" toward your future spouse. Rather, the courts assume that men and women are intelligent decision makers. As such, they are free to enter into agreements that may or may not seem "fair" in hindsight. In other words, the courts no longer assume that women are feeble. To the contrary, the courts assume that all adult individuals of sound mind and body (regardless of genger) are capable of obtaining higher education, getting an advanced earning capacity and, yes, entering into a premarial agreement absent special protection from the courts. Is A Pre-Nup Always Binding? No. A premarital agreement (or pre-nup) is voidable at the election of a party who was influenced by fraud or duress. The courts are not quick to find "fraud" or "duress, however. It is very important to disclose all of one's pre-marital assets via a written document attached to the premarital agreement prior to signing the premarital agreement. It is also important that one spouse avoid using undue pressure to entice the other spouse to enter into the agreement. For more information: |
